Maple Gift Card Terms Of Use

1. General Terms
The Maple Terms of Use apply to individuals (“you”, “your”, “User”) looking to purchase a Gift Card (“Gift Card”) through the applications, websites, content, products and services (collectively referred to as the “Maple Platform”).
If you do not have a User Account as described in the Maple Terms of Use, you must register for a User Account and provide us with your email address, first name, last name, and password in order to purchase a Gift Card.
2. Redemption
Gift Cards may only be redeemed toward Maple Cash Credits which can be used for the purchase of eligible services on the Maple Platform owned and operated by Maple Corporation (“Maple”, “we”, “us”). In order to redeem a Gift Card, you must have a User Account.
Your Gift Card balance (“Gift Card Balance”) displays the total balance of each individual Gift Card that has been applied to your User Account as Maple Credits. Purchases are deducted from your Maple Credits balance. If a purchase exceeds your Maple Credits balance, the remaining amount must be paid with another payment method, such as a credit card. To view information regarding your Gift Card Balance, log in to your Maple User Account. No fees apply to Gift Cards.
3. Limitations
Your Gift Card Balance cannot be used to purchase other gift cards. Gift Cards cannot be reloaded, resold, transferred for value or redeemed for cash, except to the extent required by law. No portion of your Gift Card Balance may be transferred to another User Account.
4. Refunds and Gift Card Balance Expiration
Gift Cards are non-refundable and they do not expire.
5. Risk of loss
The risk of loss and title for Gift Cards pass to the purchaser upon our electronic transmission of the Gift Card to the purchaser or designated recipient, or our delivery to the carrier, whichever is applicable. We are not responsible if any Gift Card is lost, stolen or destroyed, or your Gift Card Balance or any Gift Card is used without your permission.
6. Use of Gift Card Balance or any Gift Card in Violation of these Terms & Conditions
We will have the right to void Gift Cards or any other component of your Gift Card Balance, close User Accounts and bill alternative forms of payment if we suspect that a Gift Card is obtained, used or applied to a User Account (or your Gift Card Balance is applied to a purchase) fraudulently, unlawfully or otherwise in violation of these terms and conditions.
7. Limitations of Liability
THE LAWS OF CERTAIN JURISDICTIONS, INCLUDING QUEBEC'S CONSUMER PROTECTION ACT, DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR CONDITIONS OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE BELOW DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MIGHT NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.
WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO GIFT CARDS OR YOUR MAPLE GIFT CARD BALANCE, INCLUDING WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN THE EVENT A GIFT CARD IS NON-FUNCTIONAL, YOUR SOLE REMEDY, AND OUR SOLE LIABILITY, WILL BE THE REPLACEMENT OF THAT GIFT CARD.
